Q: I have joint custody of my son and he doesn’t live with his mother anymore. What are my rights?
I want to have full custody over him due to his mother being unfit but can’t prove it. I also can’t prove he lives with his grandmother other then him just telling me.
A: You may want to consult a skilled family law attorney, but the short answer is you’ll need to file a motion to modify custody in the court that established custody. If you can prove he doesn’t live with him mother, you may be able to at least obtain some degree of relief.
