Q: I have a 2 year old daughter, a 1 year old son, & a 4 month old son. They are currently in foster care. I am

predominantly black man. My daughter is a very light skinned, red hair & blue eyed girl. My sons are both darker skinned kids. I am also on her birth certificate as the father. During a court hearing, the court was, in my opinion, going to grant me custody of my children. The lawyer who represented the children, at this point, asks me to look at a picture. It was a picture of my daughter I stated. He then replied to me, " You really think this is your child." I replied, " She looks like my mother." The lawyer replied," Really, red hair." I replied," My mother has red hair." The lawyer then proceeds to ask the judge for a DNA test, which the judge agrees to. But, just for my daughter, not for my other two sons. Which, by the way, I am not on my youngest son's birth certificate. I believe the court acted with prejudice towards me & with this act, discriminated on my daughter. Was this a form of discrimination? Do I have any grounds to file a lawsuit against this court?

A: Sounds like you do not have your own lawyer. CPS does not represent you and your interests. If you want to fight for your parental rights and custody issues you must hire your own lawyer. You’ve got a lot to fight for. Good luck.
