Arlington, TX asked in Family Law for Texas

Q: My husband and I of 3 years are filing petition to change both my children's names. Non-custodial parent incarcerated.

Non-custodial parent has history of family violence towards myself and courts granted Final Permanency Order to me. Do I need to serve him still or can I request a waiver as his access is only permissible by me?

A: Do you mean Final Protective Order? If so, he should have been served with that hearing date before it occurred and therefore no additional work on your part is necessary. Now, if the Protective Order does not protect the children then you need to file other court paperwork as it pertains to them. Let us know if you’d like our assistance. 888-343-4529.
