Q: Can employer just stop scheduling or schedule you outside availability when you were hired for specific job?
I work for large retailer, when hired 10 yrs ago I was hired for shift that worked for my family they have gradually changed it. Now they are trying to change it out of my availability, which is in thier system. I know many others they just quit giving them hours. Or scheduled them causing attendance issues so they could fire them! I just feel like I started working here and built something now you say sorry we don’t wanna do that no more deal or go somewhere else. I feel like if they do away with the position/hours that I was hired for it should be just like any other lay-off they pay.
A: Generally speaking, the State of Tennessee is an Employment-at-Will State, which means that you can be terminated or demoted for any reason whatsoever, so long as it is not illegal or protected by contract. I would look to see if you have a contract with the employer. Examples of illegal activities include, but are not limited to, being fired for turning in a workers' compensation claim, violations of the Americans with Disabilities Act, violations of the Family Medical Leave Act, termination or demotion for whistleblowing and more. If you feel like you fall into one of these categories, then I would consult with a local employment discrimination attorney. Usually, they will do your case on a contingency fee, although there may be a retainer.
