Henrico, VA asked in Criminal Law for Virginia

Q: How long are circuit court case proceedings and final case dispositions kept in va?

I took a case from juvenile and domestic relationscourt where i was convicted of assault to circuit court where it was taken under advisement, and would be dropped after a period of time. This happened in 1996 it's not showing up on the online database. Will the circuit court still have some record of the final outcome of the case. This is holding me up on a background check.I need to be able to show the case was taken under advisement.

A: Not sure what you are getting at. You can go online and locate the information usually in the online court database. Records of convictions are kept a long time. I was able to locate a felony conviction from the 70's for a restoration of rights case.

A: Contact the county clerk’s office with your questions. Too frequently, files apoear to get purged after 10 years or so. But a background check will still show the arrest.

A: Circuit Court cases should be available for you to review. Older cases won't be available online. You can visit the Circuit Court Clerk's office in the jurisdiction where your case was taken under advisement and request a copy of the case. It is likely in archives and may take a few days for them to track down. If you have any paperwork whatsoever, you should being it with you, as it may have a case number on it, which will make it much easier for the Clerk to find. Good luck!
