Houston, TX asked in Family Law for Texas

Q: what legal rights does my daughters father have if hes not on her birth certificate and hardly sees her?

Ive been out of work for three months not and recently was offered a job out of state. I want to accept it but I’m worried that he’s going to try and keep me from moving with our daughter. I just want to make this as painless as possible for all of us. He’s was not involved during my pregnancy and he didn’t meet her until she was almost a month old, after he demanded a dna test so his mom bought the home kit and mailed out the swabs. I’m just looking into what the proper steps are for me to move with out him trying to fight me on it.

A: If there is no order in place one way or another then you are free to move as you like. He can file for paternity and ask the court to make determinations as to whether you should bring the child back. Good luck.
