Q: Can my neighbor constantly come onto my property taking pictures of myself and my family?

We recently had problems with them where the male neighbor attacked my boyfriend and has constantly yelled profanities at us. I just need to know if we can do anything about this

A: No. You have a right to the peaceful enjoyment of your property, whether you are an owner or a tenant. If this neighbor continues to enter your property without your permission, you have a couple of options. First, you can contact law enforcement and request that this person be issued a "no trespass" warning. If, after receiving this notice, your neighbor continues to enter your property he/she may be subject to arrest and prosecution for criminal trespass. Second, if this person has threatened you or other members of your household with violence, you may seek an injunction by filing out the required paperwork that may be obtained through your local clerk of court. Seeking an injunction will require you to appear at a court hearing and, if granted, will prohibit the neighbor from coming within a certain number of feet of your residence and/or place of work.

A: Your neighbor is violating at least two laws. Try searching for a local lawyer familiar with property rights in Florida to review all the facts and advise you what to do.
