Q: 24 hr eviction. I was allowed back on property and living in shed after sheriff left. File for eviction again?
It's complicated. Landlord allowed me and my animals to go back and live on the property. I'm in the shed. Been living on the property for almost two months. I don't want to be but my car was stolen, my ex boyfriend was verbally, mentally and financially abusing me. I need more time to get out. Does landlord have to file to evict me.
I NEED THIS INFORMATION MONDAY MORNING. I don't want to do this but I'm unable to do anything by Monday. If I can force her hand into giving me more time to get me and my animals to safety. I don't want to go to jail and have my animals taken. She wants me to be out on Monday.
A: The landlord told you that you could stay in the shed until Monday? The landlord would probably file, in the same case, for a supplemental writ of assistance, directing the sheriff to eject you from the property.

A: If you do not have a lease agreement and you are on the property without the permission of the owner, then you must leave when the owner demands that you do so. You are trespassing otherwise. If you continue to trespass on the property, then the owner may contact law enforcement to have you removed or may file an ejectment suit against you to have the court remove you, or both.

A: Although you are subject to a second eviction at any time, practically speaking it would take at least a week or more for your landlord to file the paperwork and serve you. Do not worry about "going to jail" because that is not an option. Do whatever you need to do to find another place to live, a place that will allow you to have your animals too. Good luck.
