Salinas, CA asked in Contracts, Real Estate Law, Business Law and Federal Crimes for California

Q: Can I fight for property that was never paid for years ago to my father who is no longer living in the states?

My father fled the States in 2006 after having trouble with the law but signed a bill of sale to transfer half of his business to his business partner for about $600,000 but the buyer stopped sending him money within a year. Due to this, my father signed a power of attorney to my mother (never married) in 2007 but was not helped by her lawyer and the buyer stayed with everything. As the sellers child can I do something against the buyer to get the money he owes or keep the properties he never paid for? Im aware that there is a statute of limitations but since I was a child at the time could it be tolled? Not only that but I believe there are ongoing issues of detrimental reliance and Fraud since the buyer never paid, continues to use the business, has put someone's name as a testament for one of the properties he never finished paying, and my mother’s power of attorney was ignored.
