Q: . How are assets split when wife cannot be located. Service by publication. Married less than 8 yrs

Married 2/11. Wife is drug abuser, no known address. Her mother is last known but I get no response from anyone. Courts granted service by publication. Filing under irretrievable breakdown

A: This is a medium length marriage, but you have not stated how long you have not been together nor whether you lived together prior to marriage nor whether either of you came into the marriage with assets and pension/401(k)s and whether there was an increase in the assets/value since the marriage. Usually there is a division of the increase in value and of the debt. There is no indication of whether wife was a full marital partner until going off the wagon either. You really need to hire a divorce attorney to prepare an appropriate proposed Judgment. Alimony and child support may be issues but you have not provided enough information so these issues and child custody and visitation are not addressed in your question nor this response either.
