Q: Can you sue airport for not providing help upon request which resulted in injury on escalator? No complaint was filed.

At the time of injury, it did not seem serious. This happened about three weeks ago. Due to increasing pain and no relief, an MRI was done (three weeks later) and showed completely torn tendon which needs surgery. We did not file complaint at airport or seek immediate medical help (person injured is a physician). Can a lawsuit for compensation be filed now?

the problem is that it is a blind claim meaning they don't know about it yet and will not believe........in addition to their being an issue of causation.

what did they do wrong? not provide wheelchair?

you can always sue anyone for anything...........the issue is whether you will win.

i predict you will have a hard time finding a lawyer who will take on contingency.

A: I agree with the previous answer. You will have a hard time finding a lawyer to take the case on a contingency. The airport's insurance carrier doesn't want to pay you anything and they will argue that if someone gets really hurt they seek medical attention right away. They will say "how do we know you didn't hurt it doing something else away from the airport"? And unless you have a lot of proof otherwise you really can't argue much with that logic. But let's say you had a group with you and someone happened to be videoing and caught your injury on the video.. and then everyone in your life said you were complaining of injury the whole time and FINALLY went to the doctor.... then you might have a slim chance at a case... good luck to you

A: Very difficult case, most attorney would not want to take the risk or the time. I am willing to consult with you and find out more info about a Premise Liability Claim for getting hurt at the airport, but need to find out what caused the injury on the escalator, what went wrong to make them at fault for the injury.
