Q: I have petitioned my husband. I just found out I'm pregnant, if I apply for Medicaid would that affect his process?

My husband has started his process to get a green card through me petitioning him. He already got his first acceptance letter. I am a US Citizen. Well we just found out that I am pregnant. My question is, would my husbands immigration process be affected in any way if I apply for Medicaid?

A: Although not likely to have an effect on your husband's immigration process, there has been a push by the current administration to restrict or even take away green cards when anyone in the household has received a public benefit. This is not the current policy, but policy does change. That said, short terms Medicaid for pregnancy is typically not considered a benefit that would make someone a public charge. You can check the USCIS website to uscis.gov to check for yourself. You should also be aware that you as the sponsor have to show that you meet the poverty guidelines or that you have assets to make up the difference. If not, you will need to have a joint sponsor.
