Q: can person name another to act on their behalf in lawsuit due to age & health reasons?

A: You really should discuss this with an attorney who practices in California. As a general matter, a power of attorney could enable a person to appoint another to act on their behalf in some settings, but a lawsuit is something that can personally involve a party, in terms of giving testimony, appearing for an exam, etc. As a general matter, attorneys in a case could agree to certain accommodations (for instance in terms of where a deposition might be conducted as a matter of courtesy or convenience). A California attorney could advise you about such issues and other considerations that might arise in terms of the rules evidence and civil procedure.
