Bell Gardens, CA asked in Immigration Law for California

Q: On June 4th 2019 i went to my immigration interview, regarding my green card adjust.

After my interview was completed the immigration officer told me she couldn't make a desision on my green card adjustment because she need it more information.

The emmigration officer gave me a letter where it said i needed to send by mail my brothers I-864 abd my I-864w form to see if my case gets approved.

I went to my local social security office to obtain my working record. The customer service at the social security office ask me why i needed my working record. I showed him the letter that was given to me by the immigration officer. He print out my all my years i have worked. He told me i do qualify for 40 quaters since i been working legally and filling taxes for the last 26 years.

All this information that i got from the social security office and both forms I -864 and I-864w were send about a week ago to Los Angeles immigration center. I wounder i qualified to be able and received my green card. How long it will take to get an answer from los Angeles immigration center.

A: That’s unclear. It seems that the adjudicator made a demand for a sponsor, but you chose to present evidence other than what was requested and possibly not enough to prove that you were lawfully employed with an EAD and/or work visa for the duration.

The USCIS will not necessarily look up all of your extensions to make a determination. It is unclear if ‘enough’ documents were presented to ‘opt out’ of the I-864 requirement. As a result, I strongly recommend an appointment or teleconference with a competent and experienced immigration attorney before there are any other complications. Good luck.
