Q: My boyfriend has a son but the mother has custody of him. He pays child support but he also has backed up child support.

How can we go about getting full custody.

A: Child support has nothing to do with custody. To get custody you need to demonstrate changes circumstances and that it’s in the child’s best interests

A: You should hire an experienced family law attorney to file an application for a change in custody and child support. He will still owe the child support arrears, but if the Judge grants him physical custody then she will owe him child support and it will start to even out his arrears. There are many factors involved with a change in custody and it is not something you want to attempt without competent counsel to advocate for your side.
