Pensacola, FL asked in Civil Litigation, Collections and Landlord - Tenant for Florida

Q: Collections company is seeking $2000+ for carpet replacement from 08/2016-08/2017.

We were at an apartment complex from 08/2016-08/2017. Before and after the lease we completed the inspection form and noted the status of the carpet (hard, in need of cleaning, stains). After we moved out we gave them our new address and went on with our lives just thinking we'd never see our deposit back. Fast forward to 05/2019 we are now FL residents and have been contacted by a IN collections company that we owe our old apartment $2000+ dollars for carpet replacement, cleaning. I have been trying to get ahold of the current manager for the apartment to see if they still have our records, but they aren't returning my voicemails or answering when I call. The Collection agency is going to go through the info they have and give me copies but they aren't sure if they have the inspection forms. We never got a 45 day letter at our new address not did we receive one at our former address as it is my parents current home. What can we do to resolve this. I just want the collection gone.

A: The amount of money involved is worth hiring a lawyer to review your old lease and the documents being provided by the collection company, and any other written documentation favorable to your case (like a copy of the "notifications" of the terrible condition of the carpet when you moved in). Some lawyers will provide you with a free 30 minute consultation; and most lawyers will not charge very much to review the facts and help you formulate a response.
