San Angelo, TX asked in Family Law for Texas

Q: My husband and I went through a cps case and my mother in law was granted the kids but our rights weren't stripped

Passed away in October 2018 but now my sister in law has them and she said that cps told her that they are wards of the state unless someone takes them in..our case has been closed by the way and we asked cps if they told her that and they told us that they don't know who or why they told her that because the case was closed and they had no input since the case was closed..during the case we did everything they asked and then some, have been good and on our feet with adequate housing aND transportation which was one of the stipulations on our court orders but nothing was ever good enough for my mom in law,she was always about more more money and things didn't go her way then she would threaten us with saying that she will put the kids in the system..we even asked for more visits and she threatened us with thathe as wel..there is a lot more to the case but too much to type, sis in law is a felon as well..since mom passed away shouldn't the kids come back with us for good

A: Contact a lawyer right away and provide them with all of the orders from the court. If you do not have them then they should obtain copies from the court. Your parental rights outweigh sister in law's rights. However, if you do not act right away then you are compromising your case. Good luck.
