Q: I have been getting the same amount of child support for 15 years.

My child’s father recently took me to court for more parenting time. I asked for more money for extra-curricular activities and other school fees. Now he wants to settle by paying a little extra child support. Can I asked for back child support? And what about college? He and his lawyer is trying to settle the parenting time but my daughter doesn’t want to stay with him more than a week at a time. He also said if he pays a couple extra hundred per month then I will be responsible for everything else. Curricular and extra-curricular and the like. My daughter is 16 and his pay has gone up significantly since he started paying support ( my daughter was age 1). How should I respond to the proposed settlement? I’m in Illinois. Not sure why it says Nebraska.

A: You should file a Petition to Modify Child Support. The court will only consider child support retroactive to the day of filing that petition so do it immediately. In addition to the child support, he will be responsible for a contribution to your child's extracurricular activity expenses and school fees. Make sure that you receive his financial documents including his tax returns with all supporting documents, his current pay check stubs, bank statements and financial affidavit. As far as college, keep him informed regarding your child's application process and petition the court for contribution of college expenses as soon as your child knows what college she will be attending. Your child should not be required to stay for a week at time for the father's regular parenting time.
