A: One option you have is to explore whether the insurance company provides for an appeal process of their decision to deny payment for the emergency surgery. Find out if the determination of the appeal would be binding. If it would be, depending on what is at stake in terms of the cost of the emergency surgery, you might want to consider consulting with an attorney. It isn't possible to make a call on the merits of your case without seeing the file and knowing what the pre-existing condition is, but even if the procedure was pre-existing, the fact that it arose in an emergency is something that should be considered in your favor. Good luck
