Hardin, KY asked in Child Custody, Child Support, Divorce and Family Law for Kentucky

Q: We are just starting the divorce proceedings. My son, 11, wants to stay with me in KY. His mom is in another state.

His mom filed for over $500 a month in child support and stated our assets are over $150,000 in the home. She claims only $500/mth income but she also gets disability. (1) can she get child support when he is living with me? (2) She's asking for an large amount for the home. Can she force me to pay all that money to her when the house has a mortgage and isn't worth that much? (3) She has also stated I had to pay for all the children's hospital bills including my oldest son who at 18yrs+ old was in a motor vehicle accident that he totaled a car due to taking an over dose of drugs. My youngest son does not want to be there because he stated his mom and brother, are using so many drugs, making drugs and he's afraid to be there. I don't have much money and barely make it. All of this was brought on fast because I cut her off from my bank account where she would take so much that I couldn't pay the normal bills. Can I fill for custody here in KY myself?

A: If the child is here with you in Kentucky, you can file here in Kentucky. None of the things she told you are true but you need to hire an attorney and file quickly.
