Q: Car accident question
If there was a tree down from someone's yard that fell in the street all the way across the road from ditch to ditch that caused us to have a bad accident. Can you go after the home owners insurance. There was no time to stop so we hit it at the rate of speed that the road allows.
A: The short Answer is maybe. It depends on why the tree fell and what their policy covers. It’s certainly worth looking into.

If the homeowner's policy will acknowledge the claim, it's possible they could assert the defense that the tree was a clear hazard; unlike a pedestrian darting out into the street. Good luck
