Q: Buyer signed a payment plan with me, but has not made a payment for the puppy. Can I legally take my puppy back

A family fell in love with one of my puppies. Unfortunately they could not afford to pay all at once or before the puppy was 8 weeks old & ready to go. They up a non refundable deposit down & I agreed to let them take the puppy as long as they signed a payment plan agreement. Now it has been a month & I have not received a payment, can I legally take my puppy back? Could I have animal control help me?
