Q: The apt autorenewed my lease until Oct 2020 saying i did not gave them written notice prior to 60 days of lease expirati
The apt lease is supposed to end in October 2019.I’ve moved out of state and in Dallas right now.I gave them verbal notice in Aug that i wont be extending lease, that time they did not notify me that i need to give them written notice .now apt has sent me auto renewal notice for a year without notifying me in any form.They said to break lease and need to keep on paying rent until they find new person and they do not take guarantee of filling that apt.the lease agreement has no provision of transferring lease or month to month payment.it has caused me financial difficulty in paying rent in two different state.i am worried if i need to keep on paying rent till 8-12 months even if i break lease.what should i do?
A: If the lease had an auto renew provision that required 60 days written notice to not renew, and if you did not give written notice, then the lease renewed, and you are legally obligated to pay the rent for the rest of the lease term, unless landlord makes good faith efforts to re-rent and gets a new tenant. If you don't pay, landlord could sue you. If you are in TX, it is unlikely landlord would do that, but it could, and it could get a default judgment against you in OH, and try to collect it from you in TX. And/or landlord could make an adverse entry on your credit report, lowering your credit score and making it difficult to rent from a landlord who checks.
