Odessa, TX asked in Family Law for Texas

Q: I have a court for temporary orders hearing, I want to know if I may make an opposition for hearing and a counter motio?

I was served in March 2019 with a motion to modify child support review order. Which included pleadings for what they will be making in case. Which are temporary orders and temporary restraining orders. I was then served with TRO with injunction and temporary orders but the motion only explained the TRO and the injunction. That motion was canceled for several reasons and until now it haves not being heard, last month plaintiff ask for 3rd extended TRO which was denied. But just last week I got an email with notice for temp orders hearing and said orders to be heard is motion to modify temp orders. I wanted to know if I may oppose to the hearing as there is no temp orders the only order in place is an SPO visitation orders and because I don’t have such motion in hand, the TRO was expired by law and what includes in it pertains to TRO, but nothing elsehaves ever served. Also wanted to know if I can include counter motion for contempt of court for violation of visitation for almost a year

A: You should retain an attorney in both of these actions. There will be 2 separate actions-one for initial case then if you want to complain about visitation that will be a separate one.
