Q: What is the process when you have a fall at the grocery store due to negligence on their part
The cart Corral fell over and I fell with it also causing my baby to flip over in the cart upside in the car seat. I went to the emergency room and i pulled my back and have muscle spasms. What can I do further?
A: The store would not be liable if the carts were improperly stacked by customers and not the store employees. However, it may be liable if they neglected to correct the recurring problem with the cart corral, or if they knew there was a problem at this particular time and they ignored it. A: I hope you and your baby are okay. I agree with Mr. Makridis. If the accident is attributable to the actions of another customer, the store is generally not liable. If an attorney was interested in handling the case, she or he could arrange for an investigation to look into the condition and design of the cart corral and learn if video evidence is available to shed more light on how the accident took place.
