Bryan, TX asked in Family Law for Texas

Q: Cps took my 3 kids and placed the older two with their father. He is not allowing me to see or talk to them.

The youngest child is in foster care but we already have went to court about him. I’m only asking about my older two.

A: If you have an order that allows you to have visitation and you are not getting it you can hire a lawyer to file an enforcement action on your behalf.

Make sure that you are doing everything that you are supposed to do under the order.

If the order says you are supposed to do certain things or go to a certain place to exercise your visitation at a certain time make sure that you are doing that and documenting that you did it.

A: It must be heartbreaking to be without your kids especially for the holidays. See if you can get the CPS orders or plans and then take them to retain your own attorney to pursue the proper course of action. Make sure you have all orders as it relates to the children before consulting with an attorney. You may only have to threaten the father to follow the order already in place. Good luck.
