Brooklyn, NY asked in Family Law and Child Custody for New York

Q: Violations of Court order visitation, is will be the outcome if the violation is reported to the court

My daughter has weekend visit with her mom. The Mothers son father is not allowed to be at the house during any of the visits, my daughter told me that the Mother's boyfriend is there every weekend.

What will be the next step taken by the court once this order is reported as being violated?

I know there might be a possible suspension of visitation, but that will not be good for my daughter because I would like her to be able to visit her mother.

Or what can I possibly ask the court to do?

A: The court can issue an order of protection that says the boyfriend has to stay-away during visitation and if he doesn't he can be arrested. The court can order only public place visitation or supervised visitation.

A: The court should fashion a disposition in keeping with the best interests of your daughter.
