Q: Developer states "he never agreed" to build facilities despite being listed in sales contract. What is our recourse?

This a brand new community. It's labeled as a recreational facilities agreement. It states: "The developer shall contract the following for the Largo Town Centre: ..." However, the community name is Largo Creseant. I find it odd that they would build a gym, gazebos, and tennis courts away from the community.

The HOA spoke with the developer who said "I never agreed to that..." and "where I got that."

A: You should consult local counsel to see what options you have. Without seeing the agreement it's hard to say whether anyone breached the contract.
