A: The USCIS customer service representatives get things wrong all the time. Having said that, just based on what you've said, I think you may qualify and there's nothing to lose by filing except the filing fee. If you're worried about the filing fee, then pay an attorney for a proper consultation. I'd want to ask you a bunch of questions before giving a final verdict. A quality attorney can tell you in the consultation whether you qualify for this benefit or not.
