Q: My 12 year old doesn't want to go to his fathers house anymore
Ok
A:
Yes, there is. In most courts the judge does not recognize a 12 year old as having the option of exercising his visitation time. If you choose to lie to the father about his availability that could be very detrimental to any future court you might have on custody issues. Not to mention the message that sends to the child.
If you want to curb the visitation timeshare, or convince the court the 12 year old should have an option to not visit, then you should file a Request for Order, setting a court date, so that you can attend a mediation session to see if something can be worked and if not to have a hearing so you can make your case to the Judge.
It would be wise to have experienced counsel to handle this for you because this type of request can contain hidden landmines of which you might not be aware.
