Houston, TX asked in Personal Injury for Texas

Q: Husband injured while assisting wrecker driver unloading motorcycle at my residence

Motorcycle belonging to friend of my husband was towed to our residence while owner of motorcycle was transported to hospital due to his motorcycle accident on Hwy 59 & Beltway 8 in Houston, TX on Sunday 1/5. When unloading motorcycle off ramp at our residence my husband assisted wrecker guy and oil slick at bottom of wreckers ramp caused the bike wheels to slip and lock up and both my husband and bike went backwards off ramp onto street pavement. My husband landed on right side...his right arm hit our neighbors curb. Neighbors next door witnessed what happened and assisted my 61 yr old husband off the ground. Husband went to ER the following morning as he was in major pain the night prior. ER dr diagnosed as broken right arm. Is wrecking service not liable for this as it happened off their wrecker ramp that caused his injuries. Why would wrecker driver not do his job and not allow my husband to assist him as he had no problem loading the bike on his ramp at the accident scene prior.

A: I believe I may have addressed this question earlier - at the time, it was not captioned with a geographic identifier, but it mentioned Fort Bend and a motorcycle. Your point is valid, but it could be difficult to answer your question without conducting an investigation to determine exactly what transpired at the scene, while everyone's recollections are still fresh. That's why I recommended a consult with a Texas personal injury attorney. On these types of cases, most attorneys would offer a free initial consult. Good luck
