Q: How can I get a case drop on my boyfriend for simple battery domestic

Okay my boyfriend took my phone because we had to meet up with my daughter father for some documents. My boyfriend does not want him knowing where we live and my daughter father found out where we live because child support papers. My boyfriend took my phone & text him he could not come to our house and that we can meet up somewhere. My child father started talking crap about my boyfriend and my boyfriend got upset and kept my phone as I was trying to get it back I was leaning on top to grab my phone and he tried to push me off of him but ended up pushing me off by my neck area. I got upset and hit him we went upstairs argue a little he left. I put our son to sleep Then an hour later my boyfriend and child father were outside fighting and as I was trying to break it up I got hit from the both of them not intentionally but I got bruises and scraps. My boyfriend was arrested on simple battery domestic with a no contact order. We have a one month old baby how can we get charges dropped.

A: You could go to the State Attorney’s Office and make the request. They could listen to you or ignore you. If they prosecute anyway, much of what you’ve just said might be used against you if you try to change or recharacterize your description of events. You could retain an attorney to represent only your interests. Your personal attorney would have an attorney/client privilege. You are concerned about your BF, but you need to also be concerned about yourself, and possibly your ex. The no contact order can be addressed by the court on a motion. The sooner such a motion is filed, the sooner it can be ruled on. Your personal attorney might discuss with you possible diversion options.
