Q: what is the first step in a divorce process? In which circumstance will I not to to separate 18 months prior?
A:
Thank you for your question. I know that contemplating divorce can be very stressful. The first step is to confer with an experienced family law attorney. A consultation will allow the attorney to explain your rights and make you aware of the process.
Procedurally speaking, a Complaint for divorce needs to be filed. There is no longer the requirement of 18 months separation to file for a no-fault divorce in NJ. You can file using the grounds for divorce of "Irreconcilable Differences". That means you no longer wish to be married to the opposing party, but you are not blaming either one of you for the break up of the marriage.
Many firms, including mine, offer free consultations. It would be in your best interests to explore that option before taking any other pro-active steps in the divorce process.
