Dover, NJ asked in Family Law and Child Support for New Jersey

Q: My daughter is 19 years old and undocumented as well as her mother. Mother is asking for more extention.

Apparently my daughter has registered to college fulltime. I dont understand how she is paying for college when she is undocumented. Based on her migratory status and age should I still be paying child support and for how long? When I have spoken to my daughter she tells me her mother refuses to give her money from child support.

A: Thank you for your inquiry. It sounds like you’re dealing with a difficult situation. Generally speaking, legal documentation has little to do with the payment of child support and the law calls for child support to be paid until a child is “emancipated.” The Court often requires child support to be paid to the custodial parent if a child is attending college on a full-time basis, but that is not always the case. There are certain circumstances under which that may not be appropriate, and your situation may be one of those circumstances. I encourage you to schedule a consultation with a family law attorney so that he/she can discuss your matter in more detail and guide you accordingly.
