Q: Can non green card holders legally sell items on online marketplaces?

My family has applied for a green card years back but still dont have it. I am interested in selling some items on a site called StockX.com, in which people can buy and sell clothing and footwear. It is similar to Ebay and Facebook marketplace in which items are sold and bought by individual people, not companies, unlike Amazon. So my question being whether or not we can legally sell items on online marketplaces.

A: It is unclear whether you will be able to adjust status, which may be more important to you. This may depend upon whether you somehow qualify based upon Section 245i. Was the original petition filed by April 30, 2001? In general, a person is not allow to work in the U.S. without employment authorization. Yet, some 'may' be allowed to adjust if they pay a penalty or somehow secure a waiver, then process outside of the U.S.

Due to the vague set of facts, I strongly recommend an appointment or teleconference with a competent and experienced immigration attorney, who will take the time to ask enough questions that will allow them to effectively provide good legal advice.
