Chicago, IL asked in Car Accidents for Ohio

Q: I have progressive insurance on my car. The garaging address is in Ohio where I live. My daughter was involved in a hit

& run in Al. They have totaled her vehicle and are applying the Al law to her car settlement instead of the garaging state. Please advise

A: I hope your daughter is okay. An Alabama attorney and Ohio attorney should advise on this, but your post remains open for four weeks. As a general rule, carriers can apply the law of the state in which a matter occurred. But this could be more complex, because there could be choice-of-law issues that stem from the manner in which a policy was written. It would be difficult to comment on these without knowing the provisions of the policy (the thick packet, not just the one-page declaration sheet). Good luck
