Q: To marry or not to marry!

His ex wife gives him hell about their son he pays child support every month and we have him (by papers) every other weekend and every Wednesday. My bf works swing shift so on the Wednesday’s he is at work he’s not here. When he is on days we have him after school until as late at 10pm on school nights, and just about every weekend (I have kept a running calendar of when we have him). He doesn’t stay the night often because we make him sleep in his bed (his mom lets him sleep with her still and he is 10!). One section of the divorce decree states that if either party moves the other party has to be notified by certified mail 45days before/10days after if not custody could be over turned, we don’t want to take him away from her fully. But, wants what’s fair. She moved in January and we still haven’t got one. My question is, my bf is going to petition the court for joint custody and no one pays child support. Would it look better to the judge if we were married?

A: Hello. The move must be greater than 100 miles for that provision to trigger. A local attorney where the case is can give him a better answer to the marriage question. Best of luck!
