A: Because you asked this under "DWI" I will answer based on DWI 1st.

Each case must be evaluated on its own factual merits, so the range of punishment can greatly vary.

For a DWI guilty plea, I have had cases where plea bargains were negotiated for time served, (an over night arrest) and up to 30 days jail (actual time was 10 days because the client was given 3 for one credit). Other cases were negotiated for a term of probation (not less than 6 months) for obstruction of highway, reckless driving and of course DWI. The penalty for a DWI 1st (with no complicating factors like having a child in the vehicle) would be a maximum of 1 year in county jail (actually becomes 6 months with 2 for one credit) and maximum fine of $4,000.
