Tuscaloosa, AL asked in Family Law, Child Custody and Child Support for Alabama

Q: I owe my ex mother in law child support, but she’s never had the children in her care? How can I go about fixing this

I’m trying to contact someone that could help me out with my child support case. This has been ongoing since 2010 with my ex mother in law xxx she was granted temporary custody of my children until I got on my feet, but the children were never in her care. They were with me and my ex husband from 2010-2014 where we lived in Chile. We came back in 2014 and I left my ex husband bc of his abuse to me. His mother refused to let me take my children anywhere and threw the custody case in my face. She then shortly after let my ex husband (her son) come pick them up from Michigan where he crossed the border. She paid a “coyote” money to get him back to the US illegally. He took the children to Michigan to where I had no known address and then tossed them back and forth from Michigan to Ohio. They were never in Marcia’s care and I was refused the where abouts of my children. I was blocked on social media and they changed numbers. I shouldn’t pay have to pay her.

A: As long as there is an Order for support in place, you owe the money. You need to take her back to court to get it changed, however it will have to be done where the children reside. Wherever they are, file to domesticate the Alabama judgement and then petition to modify the child support. Sounds like you have an uphill battle.. good luck!
