Longwood, FL asked in Criminal Law for Florida

Q: If I threw water on someone and the police were called but I wasn't arrested, could I still be punished in some way?

I was in an apartment and my upstairs neighbor was bothering me consistently. One night I threw water at him through the screen of his patio.

A: In theory you could still be prosecuted for a crime of some sort, but I doubt that they'll bother. And your landlord could possibly have grounds to evict you.

A: Technically it’s a battery. The neighbor will have to go to the State Attorney’s Office to prosecute.

A: Yes, throwing water at someone, if they saw it, is at least assault. (battery also, if it hit them) I think prosecution is a long shot and continues to be less likely, the longer this goes on without the other person making a police report.
