Q: i was 2k behind when my daughter moved in with me at age 13, I continued paying my ex for 3 yrs and rexived 0 from her.

I thought that this would have scratched my debt off since I kept paying and got nothing from her. I didn’t have a hearing or anything like that and now I found out she got my 1200 stimulus check. What can I do?

I did send the AG office a letter stating when this happened and what the situation was. Can I do anything about it ? And the AG office still shows that I owe 2-3k in back CS both of my kids are grown now and have been for several years.

A: You may be entitled to possession credits towards your child support obligation during the period of time that your daughter was in your care. That credit, if you get it, would apply only towards your child support obligation that existed during the time you had them. If you can get possession credits, you may be able to have the money that you continued to pay your children's mother after you got custody of your daughter apply to our old child support arrearage. It appears that your problem is based on the fact that the Court never learned of your changed circumstances and the Attorney General's office never prepared an Order that reflected those changed circumstances. The Attorney General's office may be able to assist you. If not, you will likely have to hire a lawyer to untangle these things.
