Q: Can I change my texas decree for the non custodial parent to help pay for college tuition, room, books and health ins

Does he have to help pay if he pays for his step kids to make it fair.

A: Generally speaking, Courts will not Order a parent to make payments to benefit the parent's child after the child is emancipated (i.e. turns 18 or graduates from high school). Parents can agree to include a provision in an Order which then makes it enforceable, but Courts will not enter such an Order without the agreements of the parents, especially the parent who is to be obligated to pay for things after emancipation.

A: I have never seen a court do it unless the parties agree to put it in an enforceable order.
