Q: Hi I was involved in an accident lately. Me and the person who I accidental backed into talked and settled things.

However, my insurance, a CPI won’t cover anything on her car so I agreed to pay her out of hand. She refused to make a police report but lets say she changes her mind. Will it be considered a hit and run although we exchanged numbers and she let me go.

A: A Texas attorney could best handle your question, but you await an answer for four weeks. No one can say what authorities would do if presented by a convincing story by her. But even if she did, you have your version of events, and someone who committed a hit-and-run wouldn't be likely to have the other person's phone number. I wouldn't lose sleep over it, but preserve all the things in your possession that show your good faith and willingness to work with the person - texts, emails, etc. When you pay her, think about using a release - look that up online or ask a Texas attorney. In non-legal words, it basically says, "We're done here with your acceptance of my payment for your car's damages."
