Q: Received a citation ta21-801.1 doing 88 in a 55mph zone because of being tailgated.
The officer stated i was traveling at 88mph but he wasn't doing radar but just driving down the highway same as me the reason for me speeding up was due to being tailgated i requested a trial but my question is should i obtain an attorney or represent myself?
A: This is a 5 point offense, so you are at a level where hiring a lawyer can be worth your while. It only takes 8 points within a 2 year period to get suspended, so you cannot afford a 5 point conviction. Your insurance rates will go through the roof, assuming you are not dropped with a history of moving violations. At the very least, take the MVA certified Driver Improvement Program, and have the letter of completion with you. I would also not use the tailgaiting defense. That's not a reasonable explanation for doing 33 mph over the limit.
