Q: If a case against me is waiting for prosecuting attorney to review it, how long do they have to decide to file charges?
The prosecuting attorney generally has 2 years from the date of incident to make a charging decision.
It is not normally a good idea to wait until charges are filed, as pre-charge representation and negotiations can greatly improve your situation. You should contact a criminal defense attorney ASAP.

That depends on what category of a criminal case you are looking at.
Gross Misdemeanor 2 years
Class C Felony 5 years roughly
And then up from there.
If you believe you are going to be charged with a criminal offense you should consult with an experienced criminal defense attorney.
