Littleton, CO asked in Arbitration / Mediation Law for Colorado

Q: I need to know if i can use the margin of error to dispute mileage

My odometer is not reading the actual miles. There might be some kind of computer issue since it is saying that i put 20k miles on it in 1 year which is an impossible number for me. Now because of this, i cannot get major engine repairs done with my warranty. There is only about 600 miles over the amount allowed for the warranty. If i can use the margin of error of 4%, i could maybe produce a valid dispute to the warranty company.

A: A Colorado attorney could advise best, as state consumer laws could be applicable. As a starting point, you could think about getting the vehicle tested at a shop where technicians could diagnose your system and troubleshoot your odometer/related systems for glitches. If you set up a consult with an attorney, one of the first things they could ask you is how you plan to substantiate your suspicion that there could be a problem with the accuracy of your odometer reading. Good luck

A: I just thought of something the instant I posted my response. It's an unlikely longshot with a domestic vehicle, but could It be possible your odometer is calibrated for kilometers instead of miles, a smaller unit (I km = 0.62 mi)? I don't want to get your hopes up, because the possibility is very remote, but it was just a thought. Good luck
