Dallas, TX asked in Family Law and Child Custody for Oklahoma

Q: My stepdaughter wants to live with her dad and I. She is 14 and will be 15 in October. Is there any hope in getting her?

Her step dad is emotionally abusive to her. There are 6 children in the home two of them are my husbands children. His son wants to stay with his mother but daughter has been asking to live with us since age 5.

A: If there actually is abuse in the home AND it can be proven, yes. You will need to hire an attorney to file a motion to modify.

A: Pete is spot on. If abuse, even emotional abuse, can be proven then the Judge in the family case should appoint an attorney to the child. The child's attorney then can advocate for her wish to change custody.
