Q: If my ex wife has died and my son is 30 years old do I still have to pay back child support

I was incarcerated in 2010 -2013. While I was incarcerated I had child support stopped in 2012. My son was 22 years old at the time. When I got out in 2013 my son didn’t want to see me and still wants nothing to do with me. In 2012 I owed $20;000 to chil support. In 2018 child support showed up on my credit as owing $42000. My sons mother died on June 26; 2020. I never started paying on child support after I got out. My son is 30 yrs old now. Never received any kind of letter from child support. So what can I do legally to have the child support taken off my credit or for me not to owe it anymore.

A: Hello. Some interest is owed to the mom and/or some may be owed to the state. You would need to speak with an attorney in your area who handles child support in the county where your case was, in order to set up the proper payment plan in hopes of having it over sooner rather than later. The longer you let it go without addressing it, the more interest will accumulate and that 42,000 will become 60, 70, 100+ and you will not be able to get a drivers license, passport, or tax refund/stimulus check until you take care of this.
