Lakeland, FL asked in Criminal Law for Florida

Q: Is there any sort of defense when a officer stops you with no probable cause, later stating I looked suspicious.

I would simply like to see if anybody sees any kind of defense or violations of constitutional rights when a K9 deputy in pursuit of a 18 year old black male 5 foot tall decides to stop a 37 yr old 6 foot three white man just walking down the road to the store for a drink at 3 in the afternoon? He later said I looked suspicious when I looked back after hearing his brakes to make sure I wasn't about to get got by a car. He said he just wanted to see how I'd act. I stopped and gave him my name and told him I hadn't seen any black men running that way. Then after running my name going for his handcuffs I attempted to leave the scene and the officer guns the gas and tried to run me over telling me if I didn't stop he was going to sick the dog on me..... All over a 2 year old driving on a suspended warrant I didn't know existed. Any kind of guidance would really be appreciated. My attorney said I have no case or defense to just take jail time. I have court in the morning.

A: Hire a lawyer to represent you...if you believe that you were treated improperly you may also file a complaint against the officer with his department...You should also be careful about what you write on the web because it can be used against you in a courtroom.
