Q: The mom of my almost 1 year baby is lying to child support service about my involvement with my baby & now i was serve

We have never been married

We broke up and she kept my daughter away i call i txt i go to the home and she and her family dont let me watch my daughter i offer help she does not want anything. I was there for her the hole pregnancy it all started when i made a biological test to determine if my baby was mine and it came back negative. Now i file custody for my daughter but just 1 day ago i was serve for child support in 30 days and court is in 1 1/2. I dont know what to do?

A: First you need to read the papers you were served with. Read them twice. They should have given you blank forms for you to fill out, and file back with the court, stating your side of the story. A copy of your papers also has to be mailed to the other side with a form called "Proof of Service." You can't mail it yourself. I would recommend help at the Self Help Center. Also it is unclear whether you think you are the father or you think you are not the father. You said the test came back "negative" which means you are not the father. Maybe you meant to say "positive". If you think you are not the father or you want to be sure, you should ask the judge to ORDER official paternity tests even if you had one already. If your court day is coming up in 1 and 1/2 days before you can get your papers done, be sure to go to the court anyway and ask the judge for more time to get them done. You would be asking for a continuance.

All 58 counties in California have some type of Self-Help Center. The people at the Self-Help Center help you fill out family law forms for free. They can’t do everything in family law, but they will help you with all the basics. The downside is that they don’t have a lot of time to spend with you, and often there is a line to get in to see them. The upside is that it is free. So if you have more time than money, go to the Self-Help Center for divorce, custody, visitation, paternity and domestic violence paperwork.
